Terms and Conditions

§ 1 Scope

(1) These General Terms and Conditions (GTC) apply to all contracts concluded between aberle-media GmbH, Bäckerstr. 17, 67657 Kaiserslautern, Germany (hereinafter "Provider") and the customer (hereinafter "Customer") through the online shop film-scan.com.

(2) The version of the GTC valid at the time of conclusion of the contract shall apply.

(3) Deviating GTC of the Customer shall not be recognized unless the Provider expressly agrees in writing.

§ 2 Subject of Contract

(1) The Provider offers the digitization of narrow-gauge films (Super 8, Regular 8, 16mm, 9.5mm) and related media.

(2) Product descriptions in the online shop do not constitute a binding offer, but serve for the Customer to submit a binding offer.

§ 3 Conclusion of Contract

(1) The Customer can select products from the Provider's range and collect them via the "Add to Cart" button.

(2) By submitting the order via the "Place Order" button, the Customer makes a binding offer to purchase the items in the shopping cart.

(3) The Provider confirms receipt of the order by email. This confirmation constitutes acceptance of the offer.

§ 4 Prices and Payment

(1) All prices are in Euros and include statutory VAT.

(2) Shipping costs are shown separately during the ordering process. Free shipping for orders over €50.00 (within Germany).

(3) Available payment methods: Bank transfer, PayPal, Cash on delivery (plus COD fee).

(4) For bank transfer, payment must be made within 7 days of receiving the order confirmation.

§ 5 Delivery and Shipping

(1) Delivery is made to the delivery address provided by the Customer.

(2) The Customer sends the films to be digitized to: aberle-media GmbH, Bäckerstr. 17, 67657 Kaiserslautern, Germany.

(3) Processing time is typically 10-14 business days after receipt of films and payment.

(4) Return shipping of digitized media and original films is by insured parcel service.

§ 6 Retention of Title

The delivered goods remain the property of the Provider until full payment has been made.

§ 7 Warranty and Liability

(1) Statutory warranty rights apply.

(2) The Provider is liable for damage to submitted films only in cases of intent and gross negligence. Liability is limited to the current value of the submitted material.

(3) Customers are advised to insure particularly valuable or irreplaceable films before shipping.

§ 8 Right of Withdrawal

Consumers have a statutory right of withdrawal. Details can be found in the Cancellation Policy.

§ 9 Data Protection

The Provider collects and processes personal data of the Customer exclusively within the framework of applicable data protection regulations. Details are regulated in the Privacy Policy.

§ 10 Dispute Resolution

(1) The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr

(2) We are willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) If the Customer is a merchant, the place of jurisdiction is Kaiserslautern.

(3) Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
